Filipijnse president wil één van zijn belangrijkste politieke tegenstanders achter de tralies

De Filipijnse president Rodrigo Duterte heeft de arrestatie bevolen van één van zijn belangrijkste tegenstanders in het parlement. Het gaat om senator Antonio Trillanes. Het is al de tweede senator die dreigt achter tralies terecht te komen.
Trillanes houdt zich momenteel op in de Senaat, om zijn arrestatie te vermijden. Hij is één van Duterte's felste critici. Zo heeft hij de controversiële president al verschillende keren openlijk op de vingers getikt voor zijn meedogenloze "war on drugs", en beschuldigde hij hem van corruptie. Hij steunde ook de petitie waarmee het Internationaal Strafhof in Den Haag (ICC) wordt gevraagd Duterte te vervolgen.

Duterte richtte zijn pijlen op Trillanes toen hij zijn zoon, Paolo, er openlijk van beschuldigde een grote hoeveelheid methamfetamines het land in te hebben gesmokkeld. Hij vroeg daarop de aanhouding van het parlementslid, officieel omdat de amnestie die hij in 2010 kreeg voor zijn rol in de pogingen tot staatsgreep tegen toenmalig presidente Gloria Arroyo in 2003 en 2007, nietig is verklaard. Trillanes had als jonge marineofficier meegeholpen aan die pogingen, maar kreeg van Duterte's voorganger Benigno Aquino amnestie. Die is door Duterte nu ingetrokken.

De oppositie noemt het aanhoudingsbevel "politiek gemotiveerd", en ziet overeenkomsten met de arrestatie van senatrice Leila de Lima in februari vorig jaar. Ook zij was een grote tegenstander van de president. Trillanes zelf noemt de zaak "een duidelijk voorbeeld van politieke vervolging". "Ik zal niet opgeven", klinkt het. Hij verklaarde dat hij zich niet tegen arrestatie zal verzetten.

Hoe moet het nu verder?

Wat Sara Duterte gisteren deed is strafbaar.
Er gaan dan ook stemmen op voor een impeachment (afzetting)van de Vice President.

Maar zo eenvoudig is dat niet.
De Presidenten Quirino in 1949,  Macapagal in 1964,  Marcos in 1985,  Corry Aquino in 1988,  Estrada in 2000,  Arroyo in 2005,2006, 2007 en 2008, Benigno Aquino in 2014 en tenslotte Rodrigo Duterte in 2017 en 2019.

Al deze Presidenten doorliepen een Impeachment-procedure, geen enkele kwam tot een afzetting hierdoor..

Op basis van de Filippijnse politieke cultuur lijkt elke procedure tegen de Vice President haar alleen maar populairder te maken.

Laat ze maar lekker vechten.

Leila De Lima die door vader Duterte naar de gevangenis werd verwezen in een drugzaak trekt zoals verwacht alle registers open tegen Sara Duterte
Maar met meer dan 32.000.000 stemmen achter haar naam als Vice President heeft zij natuurlijk een enorme aanhang.

Met 32.208.417 stemmen (61,53%) tegen 9.329.207 (17,82) voor de tweede zal het wel geen verschil meer maken ook al is er voor een paar miljoen stemmen gesjoemeld. De bevolking heeft trouwens aanvaard dat Sara Vice President is.

Die Marcos clan: het zijn en blijven graaiers.

Sinds vader Marcos aan de kant werd geschoven in 1986 zijn er in de Filippijnen 12 pogingen geweest tot staatsgreep.
Geen enkele was succesvol alhoewel er bij een poging in 1987 tegen C. Aquino en geleid door Gregorio Honasan 56 slachtoffers vielen.
Op het leiden van een staatsgreep staat er in De filippijnen de doodstraf, maar Honasan werd later Senator en is nu gepensioneerd.
Hier houden ze van drama, dat zijn leuke dingen voor de mensen zou Paul Van Vliet destijds gezegd hebben.
En soms zijn ze de gedubde Braziliaanse drama-soaps ook een beetje beu dus wat "real action" is altijd welkom.
Veel meer moeten we daar dus niet achter zoeken, het zal wel koelen zonder blazen zeggen ze bij ons dan.

Het zal mooi zijn, brabbelen, schelden en vloeken meer komt er niet uit bij die vent.

Gisteren heeft de kamer van volksvertegenwoordigers een afzettings procedure tegen Sara Duterte aangenomen met 215 van de 306 stemmen.

Nu is het aan de senaat om de afzetting te bevestigen maar gezien de aankomende senaatsverkiezingen op 17 mei was gisteren ook de laatste dag voor hen alvorens in verlof te gaan.

De excellenties komen dan ook pas terug samen op 2 juni.

Door het theater rond Duterte hebben ze nu toch wel een ander hoofdstuk uit het oog verloren zeker, namelijk de mogelijkheid tot echtscheiding in de Filippijnen.

Gezien er op 2 juni een deel nieuwe senatoren hun opwachting maken moet dat dossier weer van beginafaan worden opgestart.

De afzettingsprocedure tegen Sara Duterte lijkt hoe langer hoe meer op een goedkope televisie soap.

De (huidige) senaat is in verlof tot 2 juni maar pas op 28 juli komt de nieuw samengestelde senaat (na gedeeltelijke verkiezing) terug samen.

Hetzelfde scenario voor het huis van afgevaardigden.

Ik neem dan ook aan  dat alle ingediende dossiers door het oude huis van afgevaardegden waaronder ook de Absolute Divorce act House Bill 9349 in de prullenmand terechtkomen.

Maar er is meer.
Het zijn voorlopig geruchten maar waar rook is is er vuur en het gaat over veel geld.

De 215 vertegenwoordigers die voor impeacment Sara hebben gestemt zouden 50 + 100 miljoen pesos zijn beloofd voor hun district, en elk bovendien 10 miljoen in cash

Impeachment procedure-Afzettingsprocedure

Een afzettingsprocedure in de Filippijnen moet aan verschillende voorwaarden voldoen:

Volgens Artikel XI van de 1987 grondwet, kunnen volgende personen door een impeachmentprocedure worden afgezet:
The President, The Vice President, Members of the Supreme Court, Members of Constitutional Commissions (e.g., Commission on Elections, Commission on Audit,  Civil Service Commission) en de Ombudsman.

Eerst is er een aanklacht, dit kan zowel door een burger als door een lid van het huis van afgevaardigden (enkel of meervoud) worden ingediend.
Vervolgens volgt er een stemming in het huis van afgevaardigden waar minstens een derde van de leden moet voor stemmen om de zaak naar de senaat te sturen.

In de senaat wordt de zaak als rechtzaak behandeld en als 2/3 van de senatoren voor stemmen is de afzetting een feit.
In het geval van Sara Duterte zou een afzetting betekenen dat zij in de toekomst geen publiek ambt (als politieker) meer kan aannemen.

Zoals het er nu naar uitziet heeft het Internationale Criminal Court (via Interpol) een aanhoudingsbevel uitgevaardigd tegen de vorige Filippijnse President Rodrigo Duterte.

De Filippijnse Federale politie (PNP) staat klaar met 7000 manschappen om Duterte te arresteren bij zijn terugkeer uit Hong Kong waar hij tijdens het weekend een verkiezingsrally hield voor de vele  overzeese Filippijnse werkkrachten daar.

Vanmorgen werd Rodrigo Duterte gearresteerd op de luchthaven van Manila na zijn terugkeer uit Hong Kong en op vraag van het internationaal strafhof (ICC).
Hoe het nu verder moet is niet erg duidelijk.
Uitlevering aan het strafhof is uiterst onzeker voor 2 redenen.

1) De Filippijnen zijn geen lid (meer) van dit strafhof.
2) Volgens mij hebben de Filippijnen een verdrag waarbij onderdanen enkel worden uitgeleverd aan een ander land indien de misdaad buiten de Filippijnen werd gepleegd en dat is hier niet het geval.

Niets onzekers aan.

Ze waren lid van de ICC tot Duterte bang werd om gearresteerd te worden en heeft toen zonder toestemming van congress en senators de ICC opgezegd.
Bovendien kijkt de ICC ook naar misdaden begaan toen hij burgemeester van Davao was en dat was ook gedurende ICC membership.
Volgenden welke gearresteerd worden zijn Bato dela Rosa, Bong Lauwrence Go en Sarah Duterte want toen zij mayor was van Davao waren er ook vele moorden. (Rodrigo was toen vice mayor)

Misschien beter dat de Nederlanders hier zich voorlopig een beetje low-profile houden, er zijn er genoeg die denken dat Nederland ICC is.

Hij is al onderweg naar het strafhof in Den Haag - in de PH is er veel verwondering en woede om deze "ontvoering" en er wordt naar afzetting van Marcos geëist.

Mooi zo die arrestatie en uitlevering aan het ICC. Gerechtigheid kan geschieden voor zijn vele slachtoffers en hun familie.
En ook mooi dat hij het recht op een eerlijk proces krijgt en niet gewoon afgemaakt wordt als een hond. Ook hij verdient een eerlijk proces en dat zal hij ook krijgen.
"Gelukkig" waren het drugsdealers en geen homofielen waarop deze ziekelijke autocraat gefocust was.
Alles kan nu gewoon bij een bepaalde strekking....

Uw grote held had blijkbaar ook de correcte manier niet gevonden om het drugsprobleem op te lossen als president want anders zat hij nu niet achter de tralies in Den Haag voor enkele jaren tot de definitieve uitspraak volgt.

Duterte heeft het probleem 100% opgelost in Davao City en daarom wilden de mensen hem ook als president en hij heeft dit probleem ook aangepakt met resultaat.

En, als je weet dat er een zware straf op crimineel gedrag staat dan moet je dat crimineel gedrag niet begaan. Trouwens niet iedereen werd geëxecuteerd alleen na verwittigingen werden hardleerse drugdealers gestraft. Ik heb daar geen enkel probleem mee want ze wisten wat de consequenties waren als ze ermee doorgingen.

Enfin, de meningen hierover (net zoals over de doodstraf) lopen uiteen. Maar ik zie hoe ze het in Antwerpen aanpakken of nog erger in Brussel en zonder resultaat. Moesten ze er af en toe enkele afknallen zou het mss meer effect hebben als afschrikking alleen zijn we hier in Europa zo braaf.

Over welke wet hebben we het hier?

Uit documentatie blijkt dat een aanhoudingsbevel aan Duterte werd betekend toen hij van het vliegtuig stapte. Dat is dus Transit (niemandsland) en daar geldt andere wetgeving dan na immigratie

Appearing before the Senate, Duterte was boastful and carried the usual strongman aura. He even provoked people to sue him for killings done during his term.

After stepping down from the presidency in 2022, former president Rodrigo Duterte ceased to be in the public eye for years.

But when he appeared in the Senate blue ribbon subcommittee's hearing on October 28, Duterte made sure he put on full display his strongman character that enamored his diehard supporters. When asked about his drug war, the former president even boasted that he would take all the blame for the killings made by the police upon his instructions.

"I and I alone take full legal responsibility. For all the cops have done pursuant to my order, I will take responsibility. I should be the one jailed, not the cops who only followed my orders. I pity them, they were only working," Duterte said in a mix of Filipino and English.

The former chief executive showed no remorse for his war that killed at least 30,000 people, according to human rights groups. The 79-year-old Duterte even dared people to file complaints against him: "If ever all of these were true, file a complaint against me. We have courts. You'd tell me, 'How did you know people were killed?' and all, so that means you have witnesses. File the case in court or file cases in court. As I said, mine and mine alone."

(12th UPDATE) Families, human rights groups, and other stakeholders bank on the ICC to bring justice to thousands of victims, as domestic mechanisms prove to be ineffective in the quest for accountability in the Philippines

In the Senate hearing, the former president rambled and was repetitive. He admitted to having his so-called death squad and to teaching cops to prod criminals to fight back so they could justify having to kill them.


Duterte was also unfazed, as were his allies in the Senate, like Philippine National Police (PNP) chief-turned-Senator Ronald "Bato" dela Rosa. When asked if the former president's testimony in the Senate could be used against him, Dela Rosa was unperturbed.

"[The statements] may be used against him, especially that he's under oath, right? He spoke during the hearing....Well, that's how he is, right? That's how he speaks after six years of [his] presidency. He really behaves like that. Nobody can control him even if you advise him," Dela Rosa told reporters during his press conference on Wednesday, October 30. "He's a lawyer. He was a prosecutor for a long time. He knows criminal law. He really knows his stuff."

For International Criminal Court (ICC) assistant to counsel and National Union of Peoples' Lawyers (NUPL) Metro Manila secretary general Kristina Conti, Duterte's dare to file complaints against him was more of an offense move than a slip-up.

"I think the provocation, they use that in the context of intimidation. They're intimidating people. They're intimidating the families and even witnesses who are possibly cops and government officials that if they testify against Duterte, something bad might happen to them."

"[Duterte] doesn't care if the ICC will arrest him because he knows effecting that would result in a political upheaval that would benefit him and his family. They're banking on the notion that the political climate remains in their favor and that Duterte — as he has shown in the Senate hearing — can still influence and cajole his base," Human Rights Watch senior researcher Carlos Conde said.

Web of complications

Aside from Duterte's admissions in the Senate hearing, a lot of testimonies and evidence link him to the Davao Death Squad (DDS) and the killings in the drug war. For one, he clearly instructed the police to start the "war." Second, self-confessed DDS member Arturo Lascañas submitted an affidavit to the ICC detailing how Duterte gave kill orders to the DDS, among others.

So where is Duterte's confidence coming from and why is he not facing local cases for the bloody outcome of his drug war? Because Duterte had immunity from legal suits when he was president. As chief executive, Duterte could be investigated, according to NUPL president Ephraim Cortez, but could not be charged.

Another reason is, it would be hard and complicated for the PNP and the Department of Justice (DOJ) to investigate their own principal. This, besides the PNP itself being among the chief implementers of the drug war.

"It's hard to file a case in the Philippines. A lot of requirements are needed before you can sue someone, and among these requisites is evidence. This evidence is controlled by the police as they are statutorily mandated by the law to investigate any crime," Conti told Rappler. "The second one, of course, was the political atmosphere, the political framework was not conducive. Ideally, prosecutorial and judicial mechanisms should be independent and not political, but the reality on the ground was different."

Another reason is scarcity of — or rather secrecy about — drug war records. Not only the drug war families, but even independent institutions like the Commission on Human Rights, have had little to no access to drug war records to adequately conduct independent probes.

Some families of drug war victims also tend to choose silence and their safety because running after the police who killed their loved ones could put their lives at great risk. Rappler has long reported about the drug war families' plight in seeking justice for their slain loved ones and threats they face. "...Many of the relatives of victims of the killings are afraid to come out. We have to note that their relatives were killed by men in uniform, and almost all of them experienced difficulties in retrieving the bodies of their relatives because of police red tape," NUPL's Cortez noted. "Many of them were compelled to sign waivers that they will not file any case against the police."

On the one hand, these complications were the reasons why there were only a few cases filed against cops, or nothing against Duterte. But these factors, on the other hand, also mirror poor accountability in the drug war. There have been only four convictions for 30,000 victims. None of these convictions involved high-ranking police officers or Duterte, the commander-in-chief.

Here comes the ICC

"The general view is that domestic accountability mechanisms can't be expected to deliver the justice that the violations warrant, as we have seen. Nothing has changed in terms of the capability and willingness by law enforcement agencies and other bodies like the DOJ, the Ombudsman, even the CHR, so that leaves the ICC as perhaps the only viable option for justice," Conde explained.

With all the threats and red tape the families have experienced, it's understandable why some of them pin their hopes on the ICC. The investigation covers DDS killings and the early years of Duterte's drug war. The ICC still has jurisdiction over these alleged crimes since article 127 of the Rome Statute states that all proceedings prior to the withdrawal of a state from the ICC remain valid.

But relying on the ICC doesn't mean the families and counsels do not trust the local justice system, Conti explained. It's just that there are a lot of factors that make the ICC the practical choice at this point. The ICC assistant to counsel said the international court has its own independent investigating team that probes the allegations, in contrast to the Philippines where the police once led by Duterte, will conduct its own probe.

"Again, the ICC is structurally insulated.... None of the investigators.... would be appointed or related to any government official in the Philippines, whether elected or appointed. Obviously, it's an international arena.... They're not funded by government funds...by the Philippine government funds," Conti explained.

"And then lastly, obviously, they will not be affected by political changes in the Philippines or developments, considering that they don't even recognize presidential immunity," she added.

As early as 2016, then-ICC prosecutor Fatou Bensouda said her office was keeping an eye on the rising number of drug war killings in the Philippines. Before Duterte withdrew from the Rome Statute in 2018, the ICC Office of the Special Prosecutor already announced that it had initiated a preliminary examination of killings in the Philippines. Fast forward to 2023, the ICC is now at the phase of the probe where the court can issue either summons or warrants, following the appeals chamber's rejection of the Philippine government's appeal in 2022.

For human rights lawyer Neri Colmenares, Duterte's reckoning in the ICC is getting closer and closer.

"I wouldn't be surprised if the ICC will terminate its investigation soon and issue the warrant of arrest against President Duterte, at least, maybe, before the end of this year. President Duterte will be the first Asian to be tried in the ICC," Colmenares said during the Bagong Alyansang Makabayan's (BAYAN) press conference on Wednesday, October 30.

Activists, lawyers, and families of drug war victims renewed their calls on the Marcos government to use the "mounting evidence" presented in the House of Representatives' quad committee hearings, and then cooperate with the ICC. In the quad committee hearings, bombshell testimonies were already given by witnesses like retired police colonel Royina Garma and retired police officer Jovie Espenido about the start of the drug war and the reward system that was in place.

On top of these, Colmenares said they also plan to submit to the ICC any transcript, affidavit, or sworn statement from the quad committee. After all, the ICC relies on all sorts of sources, including open sources, in its investigations.

How about a new local case?

For the record, Duterte's admissions in the Senate were made under oath. Sworn statements can be admitted as evidence as long as they were duly authenticated and properly adduced. Testimonies in Senate hearings may be used in judicial proceedings, as in the case of former chief justice Renato Corona in the Sandiganbayan, where the prosecution and the defense both used transcripts of Senate impeachment proceedings as evidence.

Although there's confidence on the part of Duterte and his allies, Dela Rosa clarified that Duterte's admissions were just "jokes." It's important to note, however, that lying under oath is punishable under the Revised Penal Code. A person may be liable for perjury for lying under oath in non-judicial proceedings, while in courts, there is liability for giving false testimony.

Meanwhile, should there be local complaints against Duterte, Colmenares believes that the government should take the lead in holding Duterte accountable. For the human rights lawyer, the burden should be on the state, and not on the families, especially now that Duterte is no longer president.

"As we said, let's not give the burden of filing cases to the families of the victims. They long wanted justice. They were not just given the chance to pursue complaints," Colmenares said.

Reporters have already reached out to the DOJ for comments in response to Colmenares' remarks. We will update this story once they respond.

For now, it's clear that the clock is ticking on Duterte. Does the International Criminal Court (ICC) have jurisdiction over killings in the Philippines that allegedly were committed under the instruction of, and with oversight by, Rodrigo Duterte?

It's a straight question with less straight answers. Here are the things you need to know about the issue.

Duterte withdrew the Philippines from the ICC in March 2018 just after the ICC prosecutor opened a preliminary examination on his drug war. He did it without asking for the permission of Congress, even though ratifying it needed lawmakers' approval. The withdrawal took effect in March 2019.

This is why the ICC case against the former president covers only the Davao Death Squad (DDS) and drug war killings up to March 2019.

Roque, who was formerly Butuyan's partner in CenterLaw, has not yet responded to This Week in Asia's inquiry about why the Duterte administration retained this provision when it withdrew the Philippines from the Rome Statute in 2018, and why the Act contained Section 17 if it was solely intended for local prosecution of cases.

In a separate interview, retired Supreme Court judge Antonio Carpio said the Act "should have been used as the legal basis [for Duterte's arrest and transfer to The Hague] but so far, the Department of Interior and Local Governments and Department of Justice have not cited it as the legal basis".
When the Act was enacted by the House of Representatives in 2009, President Ferdinand Marcos Jnr and his Department of Justice secretary Jesus Crispin Remulla were then sitting congressmen.

Marcos Jnr was physically absent during the voting while Remulla voted in favour of the Act.

Carpio said: "RA 9851 came before the Philippines joined the ICC [in 2011]. It was intended to give the Philippine authorities flexibility: either to prosecute the accused in the Philippines or surrender him to the ICC.

"It was a substitute for not formally joining the ICC but retaining the option to hand over an accused to the ICC."

Lawyer Ricardo Diaz, a retired official of the National Bureau of Investigation, also told This Week in Asia that the Act was "one of the legal justifications" in Duterte's case.

The former Philippine Interpol chief said the Act granted the Philippine government "a waiver" from the extensive judicial processes under the Rome Statute.

Diaz compared Duterte's case with that involving former Yugoslavia president Slobodan Milosevic, who was also charged with committing crimes against humanity.
Milosevic was ordered in 2001 to be extradited by Yugoslav Prime Minister Zoran Dindic to face the International Criminal Tribunal for the former Yugoslavia, an ad hoc court established in The Hague by the United Nations.

Based on what Diaz witnessed on TV, he said "nothing was off" in the arrest of Duterte. "It is purely normal. The only difference is that's a former president."

Hierin wordt met geen woord gerept over ICC, het gaat enkel over de manier waarop het Filippijnse gerecht diverse misdaden moet aanpakken.

Het gevangenisleven van Duterte verschilt niet van de andere gevangenen in Scheveningen.
Zijn cel is een kamertje met eenvoudig bed, een boekenkast, toilet en wastafel.

Overdag kan hij in zijn cel blijven of zich bij de andere gevangenen voegen.

FOR the third time in two years, the Social Weather Station poll survey outfit has allowed itself to be used in creating and spreading a false portrayal of Filipinos' opinion regarding the Dutertes.

I am referring to its Feb. 15-19 survey that was reported by most media, that "51 percent of Filipinos say Duterte accountable for drug war deaths." This is blatantly fake news.

In the first place, this claim is based on a survey in which only 900 persons of those asked allegedly thought so, and for such an important issue, the article's headline should have mentioned that it was a poll.

More importantly, the SWS poll question is so seriously flawed. Any professional pollster would right away see that the SWS question is biased, and emotionally charged to result in the desired answer, which the pro-Marcos, pro-US propaganda firm Stratbase Consultancy that paid for it wanted: support for the Marcos administration's hijacking of the former president to the International Criminal Court. For its 40 years as a pollster, SWS should know this. I wonder why they pretended not to know this.

The SWS question: "Gaano po kayo sumasang-ayon o hindi sumasang-ayon na dapat panagutin si dating Pang. Rodrigo Duterte sa mga patayang may kaugnayan laban sa illegal na droga noong panahon ng kanyang administrasyon?" (How much do you agree or disagree that former Pres. Rodrigo Duterte should be held accountable for the killings related to illegal drugs during his administration?)

In Filipino, patayan is a very emotionally charged word that suggests a very deliberate massacre people should be aghast over.

It is a rule in professional polls for the pollster to reasonably inform the respondent the context and even background of the question so that he knows what he is being asked to respond to.

Even zoeken op google bevestigd het bestaan van het aanhoudingsbevel reeds 5 dagen voor de arrestatie bestond.

Vandaar mijn opmerking dat ze de DDS stemmen wil hebben voor de verkiezingen dus doet ze het ''theaterstuk'' in de senaat wat betreft de ''ontvoering'' van Duterte.

Het zal mij beniewen hoe dit allemaal gaat verlopen.
Afgelopen vrijdag, op de verjaardag van R.Duterte werden gigantische "rally's" gehouden hier in Davao. En ook in een hele boel andere steden. Honderdduizenden mensen op de been.
Het is helemaal stil gezwegen door de corrupte pers.
Evenals het feit dat de first "lady" nog steeds vast zit in de US vanwege een drugs akkefietje.
Ook een aantal rechters schijnen een bedenkelijke rol te hebben vervuld in deze hele soap.
Zou me niks verbazen als de hele zaak wordt afgeblazen vanwege vormfouten o.i.d.
En dan mag Duterte goed gaan opletten, want die Marcos kliek willen hem het liefst onder de zoden steken.
Bij Sara is dat al geprobeerd, getuige het litteken in de hals, opgelopen bij een aanslag van één van de marcos bodyguards.
Het is een grote smeerlappen bende die marcos familie. Bovendien een president die publiekelijk niet eens fatsoenlijk een vraag kan beantwoorden, de sukkelaar.

Daarbij maakt het niet uit of je vóór Marcos of Duterte bent. De feiten worden niet gepubliceerd.
Je moet zelf op onderzoek uit, zoals Folkert doet, en dan kom je wat dichterbij de werkelijke feiten. Maar een garantie is dat niet.

Volgens een paar betrouwbare bronnen, Generaal Rio, onder Duterte head DITC en Franklin Isaac banking executive hebben er gedurende de laatste verkiezingen onverklaarbare onregelmatigheden plaats gevonden. 13 millioen stemmen kwamen via een onbekend ip adres welke niet van smart en globe was (Door hun toegegeven)
Het hoofd comelec had toegezegd om bepaalde balot boxen te openen maar toen deze heren vertelden in welke plaatsen  wilde hij niet meer.  George Garcia, nu hoofd comelec, was de advocaat van BBM gedurende de jarenlange protesten tegen de winst van Leni Robredo als vice president wat door alle courts naar de fabelen is verwezen.
Afgelopen week was er een vragen ronde met George Garcia waar Franklin Isaac ook was. Toen Isaac zijn vragen wilde stellen verdween Garcia plotseling met de staart tussen de benen.

De Filippijnse staatsschuld is onder Marcos serieus opgelopen en dat is niet verwonderlijk.
Die schuld staat nu op 16,68 trillion pesos.
Toen Marcos President werd was die schuld 12,79 trillion.
Een vermeerdering van 30 % dus op 2 jaar tijd, en volgens Business Mirror zal die schuld onder Marcos oplopen tot 20,7 trillion, over 2 jaar dus.

De hoofdaanklager van het Internationaal Strafhof in Den Haag kan zijn werk amper doen omdat hij geen toegang meer heeft tot zijn Microsoft-e-mail. Dat komt vermoedelijk omdat Microsoft dat stopzette door Amerikaanse sancties tegen het ICC.
Dat schrijft de Associated Press. Karim Khan, de hoofdaanklager van het International Criminal Court, heeft volgens het persbureau geen toegang meer tot zijn e-mail. Ook zijn bankrekeningen zijn bevroren, waardoor het nagenoeg onmogelijk is geworden nog werk uit te voeren.
Het ICC gebruikt Microsoft-diensten voor e-mail. Vermoedelijk ligt het probleem bij sancties die de Verenigde Staten in februari aan het ICC oplegden. Sara is er niet content mee er komt een bloedbad aan zei ze in haar eigen woorden. :denk: 

Dat zie ik toch enigzins anders, als Sara spreekt van een bloedbad dan is het er wel een voor hen die haar willen afzetten.
Van de 12 recent gekozen Senatoren kan ze wellicht rekenen op 7 Senatoren die niet tegen haar zullen stemmen, 5 van het kamp Duterte en 2 onafhankelijken die wellicht blanco (of neutraal)stemmen en dus niet tegen haar.
De aanklager moet wel 16 stemmen verzamelen tegen de Vice President.

Het gaat trouwens al lang niet meer over schuld of onschuld.
Alles draait nu om de algemene verkiezingen van 2028 waar zowat iedereen moet gekozen worden behalve de 12 Senatoren die nu werden gekozen.
En hoe langer Marcos wacht met een duidelijk standpunt in te nemen wie hem moet opvolgen hoe meer overgebleven Senatoren gaan kiezen voor een neutrale stem om hun kansen gaaf te houden.

Er is een gezegde: If you can't beat them, join them.
En Marcos voelt de bui al hangen, dus maar duidelijk maken dat hij helemaal geen problemen heeft met de familie Duterte.

Volgens advocaat Romulo Macalintal is de impeachment zaak tegen Sara Duterte reeds dood en begraven nog voor ze is begonnen.

Niet op basis van feiten maar wegens obstakels voortvloeiend uit de grondwet.

Op 2 juni start de zaak tegen de vice-President in de Senaat.
Volgens de grondwet moet een afzettingszaak in de Senaat snel aanvangen nadat die in  het congres werd aangespannen (5 februari).
Dit is hier niet gebeurd(2 juni) bovendien komt aan de huidig samengestelde Senaat een einde op 30 juni samen met het 19de congress.

Een landelijk gekozen senator heeft o.a. als taak om als onafhankelijk judge een impeachment ta horen en te beslissen wat er met de persoon gebeurd. Wel schuldig, niet schuldig.
Het feit dat meerdere DDS weigeren om een impeachment te houden zoals Padila, Go, Bato, Vilar, Escudero, Eemi Marcos etc houdt in dat ze hun taak als senator niet vervullen. In de Filippijnen is er het huis van afgevaardigden, de Senaat en de Supreme Court waarvan de Supreme court het hoogste orgaan is als het komt tot rechtzaken. Senaat is van lagere orde en de afgevaardigden komen op de derde plaats.

In een artikel in de Manila Times vindt Antonio Contreras het optreden en de uitlatingen van Senaatsvoorzitter Escudero problematisch.

Het gaat dan over het woord forthwith (onmiddelijk)in de afzettingszaak tegen Vice President Duterte.
Verder heeft hij het over het standpunt van Escudero wat betreft de mogelijkheid om de Impeachment zaak stop te zetten (dismiss the impeachment)door een eenvoudige stemming in de Senaat.

Artikel XI, section 3(6) van de grondwet maakt duidelijk dat enkel de Senaat bevoegd is om een impeachment uit te spreken,en is omschreven als "sole power" (alleenrecht).

Omdat Chiz Escudero, Duterte vriendje en speaker of the house, het niet behandelde met wat in de wet staat als direct (Forthwith) is het dusd 2x binnen een jaar gestuurd en nu onconstitutional. In this MR, like any MR on cases before the court, the complainant or petitioners should present hard evidence to refute the basis for the SC decision . It must be new and not rehash of arguments presented so Justices can reconsider its decision . Danger is SC can make a decision calling their earlier decision as final and executory with no more MR. The law allows at least 2 MRs that can be filed unless the SC makes decision with finality.  If the SC still fails to give weight to the hard evidence which refutes their rationale for calling IC unconstitutional, then the MR is doomed.  There won't be any trial because present Senate body has already made a decision not to hold trial based on SC decision.
The other scenario that can happen if the MR is trashed, the HOR can now file impeachment against all 15 justices. There is no prohibition as to the number of justices who can be impeached. The grounds for this impeachment are culpable violation of the constitution and betrayal of public trust. Just anyone of this is enough to impeach the justices.
The justices may be called by the HOR to explain their side as part of due process . Failure to attend hearings by the HOR means the justices are waiving their rights to be heard .
After securing the necessary votes (2/3) from the HOR, the HOR can submit the articles or impeachment to the Senate to conduct trial of the Justices.
The impeached justices cannot run to themselves to declare the HOR impeachment against them is unconstitutional.
This will make the justices paralyzed as they face possible removal from the SC .
Since this is the first time all the justices will be impeached, this can go on trial .
Meanwhile, the HOR can wait next year to refile impeachment against the VP.
Nobody can call this a constitutional crisis as the justices themselves are the subject of impeachment. Remember, justices are all impeacheable officials of the govt .
When justices are impeached, the incumbent president can nominate new justices to fill the vacancies temporarily. The acting justices have to be confirmed by the Commision on Appointment composed of members of the HOR and senate 
I am checking this opinion by this political guru with lawyers familiar with constitutional cases and impeachement to validate the above.
Agree or not, if the justices are impeached by the HOR, who can challenge before the SC that the HOR act is again unconstitutional .
Let the HOR try this scenario to prove no one is above the law when it comes to impeachment process.
By hindsgiht and foresight, SC justices can and should reverse their decision to avoid being removed from the SC.
If this happens, this  will go down in history and jurisprudence as  nobody will be around to render judgement on cases pending with the justices.
My personal view is the Justices should have been more circumspect about what they did  and to correct the injustice, they should revoke  their earlier  judgment calling the IC filed by the HOR as unconstitutional to avoid losing their seats and humiliation from the public.

In a statement signed by PhilConSa chairperson and former chief justice Reynato Puno, the group expressed grave concern over the imposition of seven new rules in impeachment proceedings, set by the SC for compliance by the House of Representatives.

The statement issued over the weekend said the new rules gave the SC powers "that can deprive the House of its exclusive power to initiate all cases of impeachment," thereby violating Article XI (3) of the Constitution.

It noted that the requirement that the draft Articles of Impeachment should be accompanied by sufficient evidence and there should be reasonable time wherein members of the House could decide whether or not to endorse the complaint could be used by the impeached official to raise the matter to the SC.

De Senaat heeft beslist om de impeachment procedure tegen VP Sara Duterte verticaal te klasseren.
