De hoofdadvocaat van Rodrigo Duterte, Nicholas Kaufman, gaat ervan uit dat zijn client moet terugkeren naar de Filippijnen.

Hij baseert zich daarvoor op een regel van het ICC namelijk principle of complementarity wat betekend dat het ICC enkel kan optreden als de (Filippijnse) staatsrechtbanken hiervoor  onwillig of onbekwaam zijn om recht te spreken in hun eigen grondgebied.

Indien hierom gevraagd en zij weigeren dat overtreden ze hun eigen regels.
Voor een internationale organisatie kan zoiets tellen, er zijn voldoende (grote) landen die niet liever vragen om het ICC met de grond gelijk te maken.

Als de politie valse rapporten maakt omddat ze zelf de moordenaars zijn, de meeste supreme  justices benoemd zijn bij de president welke toestemming gaf en hun salarissen verdubbelde en bonussen gaf voor de moorden dan kun je nergens anders heen dan naar ICC, daar is het voor uitgevonden.

Court had jurisdiction to investigate and try the former president

Does the International Criminal Court (ICC) have jurisdiction over killings in the Philippines that allegedly were committed under the instruction of, and with oversight by, Rodrigo Duterte?

It's a straight question with less straight answers. Here are the things you need to know about the issue.

Duterte withdrew the Philippines from the ICC in March 2018 just after the ICC prosecutor opened a preliminary examination on his drug war. He did it without asking for the permission of Congress, even though ratifying it needed lawmakers' approval. The withdrawal took effect in March 2019.

This is why the ICC case against the former president covers only the Davao Death Squad (DDS) and drug war killings up to March 2019.

Duterte asserts that the ICC had lost jurisdiction over him because the government is no longer a member. ICC Prosecutor Karim Khan fought hard to convince ICC judges to allow him to continue, which they did twice, the last one in January 2023.

By this time, it was already the term of President Ferdinand Marcos Jr., who also believed that the ICC had no jurisdiction. Thus, in February 2023, it was under Marcos that Solicitor General Menardo Guevarra hired a foreign external lawyer to beef up the non-jurisdiction argument in the ICC, to stop the investigation. They went to the appeals chamber for one more shot.

The Marcos-Guevarra tandem, with the help of British barrister Sarah Bafadhel, almost won but lost by a hairline. The ICC appeals chamber voted 3-2 in July 2023 to let the investigation continue.
